Spectator Liability Waiver
Acknowledgment and Assumption of Risk and Release of Claims for Spectating the Competition — for URBANWAVE 2026 ticketed spectators
Last updated: 2026-06-22
I. Overview and Scope
Please read this entire document (the "Waiver") carefully. This Waiver applies to spectators who purchase a ticket to spectate the URBANWAVE 2026 competition and enter the venue (the "spectator" or "I"), and consent is obtained at the time of ticket purchase. The risks and release applicable to athletes competing in the Competition are governed by a separate Participant Liability Waiver.
I acknowledge and agree to the following in consideration of the services provided by AfterAction Co., Ltd. (the "Company") that grant me admission to spectate the URBANWAVE competition and related activities (the "Competition").
Minor spectators: Minors may also enter as spectators. Where a minor spectates, the legal representative (guardian) shall review the contents of this Waiver and agree to it on behalf of the minor, and shall be responsible for accompanying, protecting, and ensuring the safe spectating of the minor. The guardian who purchased the ticket warrants that they have informed the accompanying minor of the contents of this Waiver, and confirms that responsibility for the protection and safety of the minor within the venue rests with the guardian.
II. Acknowledgment and Assumption of Risk
A. Spectating Environment and Risks. I acknowledge that spectating the Competition and engaging in activities within the venue (including but not limited to entry and exit, movement and spectating within the venue, and use of amenities, spectator seating, and walkways, collectively the "Spectating Activities") involves inherent and incidental risks ("Risks") that may cause injury, damage, death, or other loss. I acknowledge that the Risks applicable to Spectating Activities include, without limitation, the following:
- 1. Risks relating to the venue environment. These include risks encountered in the venue environment, such as slipping, tripping, or falling, contact with floors, stairs, equipment, or fixtures, and noise, lighting, and stage effects.
- 2. Risks relating to congestion and crowds. These include risks relating to density and congestion along entry, exit, and spectating routes, and collisions with or pressure from other spectators and visitors.
- 3. Risks relating to the conduct of the competition. These include risks from equipment, apparatus, or objects that leave the competition area, incidental contact with athletes or competition operations staff, and the movement routes and operation of the competition. I must comply with safety lines, controlled areas, and the instructions of operations staff.
- 4. Risks relating to individual health condition. Risks associated with a spectator's mental, physical, or emotional condition (including the use or misuse of alcohol, prescription medication, or over-the-counter medication), whether disclosed or not, may cause injury, damage, death, or other loss.
- 5. Risks relating to supervision. I agree that the Company, its employees, and agents will not be supervising individual spectators at all times during the event. Responsibility for the protection and supervision of minor spectators rests with the accompanying guardian.
- 6. Risks relating to conduct. This refers to the risk that spectators, other visitors, or third parties may act negligently or intentionally.
- 7. Risks arising from the unlawful acts of third parties or from external factors that are difficult to foresee. Risks may arise from the unlawful acts of third parties or from external factors that are difficult to foresee.
I understand and accept that unexpected collisions, falls, or other safety incidents may occur as a result of the movement of athletes during competition, the transport of equipment, competition operations, and spectating routes.
B. Potential Incidents. Should the above or other Risks materialize, I or those accompanying me may lose balance and fall, collide with objects or people, or suffer fractures, trauma, psychological or emotional shock, injury, damage, death, or other loss.
C. Code of Conduct. I agree to: (1) refrain from endangering others through drugs or alcohol that impair judgment; (2) respect the rights, dignity, and worth of all individuals, including athletes, volunteers, and other spectators; (3) not discriminate against anyone on the basis of gender, race, religion, ability, or otherwise; (4) respect all property, including venue facilities and equipment; and (5) follow the lawful instructions and controls of operations staff, safety personnel, and medical personnel, refrain from entering controlled areas or competition areas without authorization, and take responsibility for my own conduct.
D. Assumption of Responsibility. I acknowledge that the Company cannot guarantee my safety or prevent all Risks. I am voluntarily spectating the Competition and agree to accept and assume responsibility for any injury, damage, death, or other loss sustained by me (or, in the case of a minor, the accompanying minor) as a result of the inherent and other Risks of Spectating Activities (including both known and unknown risks) and the negligent or intentional acts of myself, other spectators, or third parties. I understand and agree that responsibility for any incident arising from my own carelessness or my failure to follow the safety instructions and controls of operations staff rests with me.
III. Release of Claims
Please read the contents of this section carefully. This release contains provisions relating to the waiver of certain legal rights.
A. Release. To the extent permitted by Applicable Law, I agree not to bring against the Company, competition sponsors, organizers, employees, officials, contractors, and volunteers, venue owners, and each of their parent companies, affiliates, officers, agents, and others (collectively, the "Released Parties") any claim, liability, suit, or expense (collectively, "Claims") arising from any injury, damage, death, or other loss occurring in connection with spectating the Competition and entering the venue (including use of amenities). I hereby waive all Claims I may have against the Released Parties pursuant to this Waiver and agree that, to the extent permitted by applicable laws, I will not bring against the Released Parties any claim for damages, indemnity, or recourse, or any other claim whatsoever.
B. Scope of Released Claims. This release covers Claims arising from the negligence of the Released Parties, including Claims for personal injury or death (including emergency treatment and medical expenses), property loss, and other Claims. However, this release does not apply to loss of life or personal injury caused by the willful misconduct or gross negligence of the Released Parties (as governed by applicable consumer protection legislation).
IV. Miscellaneous Provisions
A. Dispute Resolution. I agree that any and all disputes or Claims that may be brought in connection with this Waiver and my spectating of the Competition shall be: 1) interpreted in accordance with the laws of the Republic of Korea; and 2) subject to the jurisdiction of the courts of the Republic of Korea under the Civil Procedure Act.
B. Entire Agreement. In the relationship between the Company and me, this Waiver supersedes any other agreement.
C. Medical Treatment. I agree that, where an emergency makes it difficult to confirm my wishes (or, in the case of a minor, the wishes of the accompanying minor) immediately, the Company's employees, agents, and medical personnel may carry out any necessary emergency first aid and transport to a medical facility based on their professional judgment, and I will cooperate fully with this. I agree to pay the costs arising in connection with such treatment, ambulance use, and transport to a medical facility, and consent to the disclosure of necessary information to healthcare providers and others for first aid and billing purposes in accordance with the Personal Information Protection Act.
D. Denial of Admission/Ejection. The Company may restrict a spectator's admission, or deny admission to or eject a spectator, where it determines this to be necessary for the safety of spectators or athletes, the maintenance of competition order, or the smooth operation of the event. This applies to cases such as failure to comply with safety instructions or controls, harm to others, and damage to facilities or equipment.
E. Image and Media. I agree that photographs, video, and audio may be captured at the Competition site, and that the captured content may incidentally include the image of me as a spectator (or, in the case of a minor, the accompanying minor). I agree that the Company may use such content for the Competition's records and promotion and in related media (including broadcasting, publications, websites, social media, advertising, and promotion). If I do not wish to be filmed, I may contact on-site staff in accordance with the on-site notices. The Company may edit, modify, reproduce, distribute, and publicly transmit the captured images and video without time limit. (The details of personal information processing are governed by the Company's Privacy Policy and the venue's Filming Notice.)
F. Assignment. The Company may assign this Waiver to another legal entity or individual (the "Assignee"), and such assignment shall be deemed to grant the Assignee all the rights and protections of the Company and the Released Parties under this Waiver.
G. Effective Date. This Waiver is effective from the date of consent until the completion of spectating the Competition and shall remain in effect after spectating has concluded.
H. Construction. This Waiver shall be construed and enforced to the fullest extent permitted by Applicable Law. If any provision is found to be unlawful or unenforceable, the remaining provisions shall continue in full force and effect.
I. Voluntary Agreement. I have read and understood this Waiver and agree to it voluntarily, and acknowledge that it is legally binding on me (or, in the case of a minor, on the minor's legal representative and the minor), my heirs, and my agents. I confirm that I have had sufficient time to review this Waiver and the opportunity to seek legal advice if needed.
V. Safety Measures and Spectating Restrictions
The Company's competition operations staff, safety personnel, or medical personnel may restrict a spectator's access to certain areas, control movement within the venue, restrict spectating, or eject a spectator where they determine this to be necessary for the safety of the spectator or other participants, the safety of the venue, or the smooth operation of the event. Spectators must cooperate fully with any such measure and will not claim a ticket refund or damages as a result.
How Consent Is Given
At the time of ticket purchase, the purchaser agrees to this release, and where a minor is accompanied, the guardian agrees on behalf of the minor. The guardian who purchased the ticket warrants that they have informed the accompanying minor of the contents of this Waiver.
