I. Overview
Please read this entire document (the "Waiver") carefully. All competition participants are required to agree to this Waiver. If the team's average age is 19 or older as of the competition date, a minor team member may participate with the consent of a guardian (legal representative).
The undersigned ("I" or "me") acknowledges and agrees to the following in consideration of the services provided by AfterAction Co., Ltd. (the "Company") that enable me to participate in the URBANWAVE competition and related activities (the "Competition").
Two-person team participation: URBANWAVE is a two-person team competition. Both team members are bound by this Waiver. At the time of registration, the lead applicant agrees to this Waiver on behalf of both team members. The lead applicant warrants that they have informed the other team member of the contents of this Waiver and obtained that person's agreement, and confirms that they have been duly authorized to obtain the other team member's consent.
II. Acknowledgment and Assumption of Risk
A. Activities and Risks. I acknowledge that participation in competition activities and other activities (including but not limited to warm-up exercises, running, use of equipment and facilities, training, demonstrations, participation in other athletic activities, and other activities, collectively the "Activities") involves inherent and incidental risks ("Risks") that may cause injury, damage, death, or other loss. I acknowledge that the Risks applicable to Competition Activities include, without limitation, the following:
- 1. Risks inherent in all competitive and athletic activities. Training, practice, or competition aimed at developing strength, endurance, or other physical conditioning challenges physical and mental limits.
- 2. Risks relating to decisions and actions. The Company's employees, agents, volunteers, contractors, or fellow competitors may be unable to fully ascertain or accurately judge an athlete's abilities, health, or physical condition; each athlete is responsible for checking their own health condition and deciding whether to compete.
- 3. Risks relating to running. These include the risk of losing control and falling, colliding with objects or people (including fellow participants, volunteers, and spectators), or tripping during running activities.
- 4. Risks relating to individual health and participation. Risks associated with a participant's mental, physical, or emotional condition (including the use or misuse of alcohol, prescription medication, or over-the-counter medication), whether disclosed or not, may cause injury, damage, death, or other loss.
- 5. Risks relating to supervision and activities. I acknowledge that the Company, its employees, agents, and others will not be supervising me at all times during Competition Activities.
- 6. Risks relating to conduct. This refers to the risk that participants, fellow participants, or third parties may act negligently or intentionally.
- 7. Risks arising from the unlawful acts of third parties or from external factors that are difficult to foresee. Risks may arise from the unlawful acts of third parties or from external factors that are difficult to foresee.
I fully understand and accept that collisions, falls, or other safety incidents may occur during competition as a result of contact with other athletes, lane movement, overlapping competition flow, the use of equipment, and similar circumstances.
B. Potential Incidents. Should the above or other risks materialize, I or those accompanying me may lose balance and fall, collide with objects or people, suffer gastrointestinal or cardiopulmonary illness or conditions, dehydration, hyponatremia, fractures, paralysis or other permanent disability, psychological or emotional trauma, or sustain injury, damage, death, or other loss.
C. Pre-Participation Review. I agree to review all materials provided, to complete all registration information, documents, and procedures accurately, and to comply with all rules and policies. I have decided to compete after personally checking my readiness to compete, including my health condition and personal equipment.
D. Code of Conduct. I agree to: (1) refrain from using drugs or alcohol that impair judgment or performance; (2) respect the rights, dignity, and worth of all individuals, including athletes, volunteers, and spectators; (3) not discriminate against anyone on the basis of gender, race, religion, ability, or otherwise; (4) respect all property, including accommodation, athletic facilities, and equipment; (5) act with integrity; and (6) follow the lawful instructions of competition operations staff, referees, and medical personnel — and take responsibility for my own conduct.
E. Assumption of Responsibility. My final assumption of responsibility and participation in the Competition is based on my review of all required information and documents provided by the Company. I acknowledge that I had ample opportunity to inspect the facilities and areas of use prior to participating in Competition Activities, if I wished to do so. I acknowledge that the Company cannot guarantee my safety or prevent all Risks. I am voluntarily participating in the Competition and agree to fully accept and assume responsibility for any injury, damage, death, or other loss I sustain as a result of the inherent and other Risks of Competition Activities (including both known and unknown risks) and the negligent or intentional acts of myself, fellow participants, or third parties. I agree that, if I feel unwell or experience any physical abnormality during competition, I will immediately stop competing or cooperate fully with the measures of the medical personnel and competition operations staff. I further understand and agree that the Company shall bear no responsibility where the team is unable to compete normally or to finish as a result of a team member's injury, ill health, withdrawal, or disqualification.
III. Release of Claims
Please read the contents of this section carefully. This release contains provisions relating to the waiver of certain legal rights.
A. Release. To the extent permitted by Applicable Law, I agree not to bring any claim, liability, suit, or expense (collectively, "Claims") arising from any injury, loss, damage, death, or other loss resulting from my application for or participation in Competition Activities (including use of equipment and facilities) against the Company, competition sponsors, organizers, employees, officials, contractors, and volunteers, venue owners, and each of their parent companies, affiliates, officers, agents, and others (collectively, the "Released Parties"). I hereby waive all Claims I may have against the Released Parties pursuant to this Waiver and agree that, to the extent permitted by applicable laws, I will not bring against the Released Parties any claim for damages, indemnity, or recourse, or any other claim whatsoever.
B. Scope of Released Claims. This release covers Claims arising from the negligence of the Released Parties, including Claims for personal injury or death (including emergency treatment and medical expenses), property loss, loss of consortium, breach of contract, and other Claims. However, this release does not apply to loss of life or personal injury caused by the willful misconduct or gross negligence of the Released Parties (as governed by applicable consumer protection legislation).
IV. Miscellaneous Provisions
A. Dispute Resolution. I agree that any and all disputes or Claims that may be brought in connection with this Waiver and my participation in the Competition shall be: 1) interpreted in accordance with the laws of the Republic of Korea; and 2) subject to the jurisdiction of the courts of the Republic of Korea under the Civil Procedure Act.
B. Entire Agreement. In the relationship between the Company and me, this Waiver supersedes any other agreement.
C. Medical Treatment. I authorize the Company's employees, agents, and medical personnel to arrange any medical treatment deemed necessary to protect my health (including transport, hospitalization, surgery, and administration of medication). I agree that, where an emergency makes it difficult to confirm my wishes immediately, any necessary emergency first aid or transport to a medical facility may be carried out based on the professional judgment of medical personnel, and I will cooperate fully with this. I agree to pay the costs arising in connection with such treatment, ambulance use, and transport to a medical facility, and consent to the disclosure of necessary medical information to healthcare providers and others for treatment and billing purposes in accordance with the Personal Information Protection Act.
D. Participation Restriction and Ejection. The Company may restrict, suspend, or cancel an athlete's participation, or eject an athlete, where it determines this to be necessary for the safety of the athlete or others, the maintenance of competition order, or the smooth operation of the Competition.
E. Image Rights. I grant the Company and its contractors and assigns the right to use my name, image, voice, written statements, photographs, and/or visual likeness (collectively, "Image") in all media worldwide for various purposes, with no time limit (including broadcasting, photography, publications, websites, social media, related merchandise, information, education, advertising, and promotion). The Company may edit, modify, reproduce, distribute, and publicly transmit the captured images and video. I agree that all ownership and copyright in such Images vest in the Company and waive all rights of approval. I consent to my name, participation number, and competition results being made public during or after the Competition.
F. Assignment. The Company may assign this Waiver to another legal entity or individual (the "Assignee"), and such assignment shall be deemed to grant the Assignee all the rights and protections of the Company and the Released Parties under this Waiver.
G. Effective Date. This Waiver is effective from the date of consent until the completion of all Competition Activities and shall remain in effect after the conclusion of Competition Activities.
H. Construction. This Waiver shall be construed and enforced to the fullest extent permitted by Applicable Law. If any provision is found to be unlawful or unenforceable, the remaining provisions shall continue in full force and effect.
I. Voluntary Agreement. I have read and understood this Waiver and agree to it voluntarily, and acknowledge that it is legally binding on me, my spouse, heirs, executors, agents, and estate. I confirm that I have had sufficient time to review this Waiver and the opportunity to seek legal advice if needed.
V. Suspension of Competition and Safety Measures
The Company's medical personnel, referees, or competition operations staff may restrict an athlete's participation, suspend the competition, or exclude or eject an athlete where they determine this to be necessary for the safety of the athlete or other participants, the safety of the venue, equipment malfunction, or the smooth operation of the competition. Athletes must cooperate fully with any such measure, and even if, as a result, an athlete is unable to finish the competition or their result is not recognized, the athlete will not, except to the extent permitted by applicable laws, raise any objection against the Company or claim damages.
How Consent Is Given
At the time of athlete registration, the lead applicant provides consent to this Waiver on behalf of both team members, and warrants that they have informed the other team member of its contents, obtained that person's agreement, and been duly authorized to obtain that consent.
